ARE SOLD ON AN “AS-IS, WHERE-IS” BASIS WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.


The description of each vehicle or piece of equipment is solely for the purpose of identification and does not constitute a representation or warranty that the item will conform to such description or to any condition referred to therein. Monster Equipment Inc. has not conducted a comprehensive inspection of the item, and there is no certification of operability.


MONSTER EQUIPMENT INC. MAKES NO WARRANTY THAT THE VEHICLE OR EQUIPMENT WILL PROPERLY FUNCTION OR OPERATE AFTER REMOVAL OR DELIVERY, NOR THAT IT WILL CONTINUE TO OPERATE OR FUNCTION FOR ANY PERIOD OF TIME THEREAFTER.


INSPECTIONS

Monster Equipment Inc. is not responsible for any inspections of a vehicle or equipment item prior to or after purchase. Any conditions or notes provided by Monster Equipment Inc. are solely for the purpose of reporting on the visible condition of the item’s major systems and attachments observed on the day of inspection and do not include road testing or load testing of mechanical condition.


Purchaser acknowledges that conditions can change between the time of inspection and the time of delivery or removal. Purchaser further acknowledges that, unless otherwise stated, any miles, kilometers, or hours listed in the description are obtained from a visual reading of the odometer and/or hour meter, and no guarantee is made that such readings reflect the actual miles, kilometers, or hours of the vehicle or equipment.


Purchaser is solely responsible for any inspection required with respect to vehicles or equipment that have upper units or chassis (e.g., cranes, man lifts, buckets, diggers, construction equipment, trailers, or vehicles of any type). Purchaser is solely responsible for ensuring that each item receives thorough inspections according to the manufacturer’s recommendations by qualified persons who are able to detect and assess defects and potential hazards that could limit the safe performance of the item’s functions.


FEES AND TAXES

(a) For each vehicle or equipment item purchased from Monster Equipment Inc., Purchaser agrees to pay any applicable transaction or documentation fees. Monster Equipment Inc. may change or add additional fees from time to time, in its sole discretion, with or without notice to Purchaser. Other fees that may be payable are detailed in the applicable sales documents or invoice.


(b) Sales tax will be collected in accordance with applicable Florida law and regulations. The applicable tax rate is determined by the physical location of the vehicle or equipment at the time of sale.


(c) To support proper sales tax treatment, Purchaser is responsible for providing Monster Equipment Inc. with any necessary documentation (e.g., Bills of Lading, export documents, etc.) no later than ten (10) business days from the date of purchase. If Purchaser has a valid exemption certificate that was not submitted at the time of sale, Purchaser has ten (10) business days from the date of purchase to submit it for processing a refund. After ten (10) business days, Purchaser will need to submit any refund request directly to the Florida Department of Revenue.


TITLE TO VEHICLES

(a) With respect to each vehicle for which Monster Equipment Inc. has received payment in full and all requested paperwork from Purchaser, Monster Equipment Inc. will use its best efforts in accordance with Florida law to transfer clear title to the Purchaser, unless otherwise provided in the sales documents. However, Monster Equipment Inc. shall not be responsible for any losses, damages, attorney’s fees, costs, interest, or any other damages resulting from any delay in obtaining or transferring title.


(b) Monster Equipment Inc. acts as the seller of the vehicles and equipment. In some cases required by Florida law, title documentation may be processed through Monster Equipment Inc.’s dealer license. Any such processing is done solely to comply with applicable state law and does not change the fact that legal title passes from Monster Equipment Inc. to the Purchaser upon proper completion of transfer documents.


(c) Titles and other ownership documents will be issued in the name and/or company name under which the Purchaser registered or provided at the time of purchase. This information cannot be changed after the sale, so please ensure all registration and buyer details are accurate.
